Overview

Hallowicked operates hallowicked.com, including the information, content, tools, products, and services available through this store (the “Services”). The terms “we,” “us,” and “our” refer to Hallowicked. Our store is hosted by Shopify. By accessing the Services or placing an order, you agree to these Terms and the policies linked below. If you do not agree, do not use the Services. Mandatory consumer rights prevail over any conflicting provision.

1. Access and accounts

You must be at least the age of majority where you live or use the Services under a parent or legal guardian’s supervision. You are responsible for accurate account information and safeguarding your credentials. Do not impersonate another person or use the Services unlawfully. Contact us if you suspect unauthorized use of your account.

2. Products and safe use

We sell Halloween costumes, costume accessories, seasonal decorations, and related merchandise. Images and colors may differ slightly by screen. Review each product’s size chart, materials, measurements, included pieces, age guidance, and care instructions before ordering. Availability and descriptions may change.

Costumes, masks, and props are intended for decorative or dress-up use, unless a product expressly states otherwise; they are not protective equipment. Follow all manufacturer warnings. Keep costumes and decorations away from open flames and heat. Ensure masks do not obstruct breathing or vision and that costumes do not create trip hazards. Small parts may present a choking hazard; supervise children. Use electrical or outdoor decorations only as rated and directed, and do not use damaged products. These precautions do not limit our responsibility for defective goods or your statutory rights.

3. Orders

Placing an order is an offer to purchase. An automated order receipt acknowledges receipt but does not guarantee acceptance. We may decline or cancel orders for unavailability, suspected fraud, pricing errors, or other lawful reasons. If we cancel a paid order, we will notify you and refund the affected amount. Requests to change or cancel an order should be sent promptly and cannot be guaranteed once processing or shipment begins.

4. Prices, billing, and payment

Store prices are in US dollars (USD) unless another currency is expressly displayed. Applicable taxes and shipping are shown before you confirm payment. Promotions may have separate stated conditions. You agree to provide complete and accurate payment, billing, and delivery information and confirm that you are authorized to use your chosen payment method. Available payment methods are displayed at checkout. Prices may change for future orders without affecting an accepted order’s agreed price.

5. Shipping and delivery

Our Shipping Policy describes destinations, rates, processing, and estimated delivery times. Delivery estimates are not a guarantee of arrival before Halloween or another event unless expressly confirmed. Contact us about delays, loss, damage, or incorrect shipments. We will provide remedies required by applicable law; these Terms do not transfer away mandatory consumer protections.

6. Returns and refunds

Our Return and Refund Policy governs return eligibility, requests, costs, exceptions, and refund timing. Please request instructions before returning merchandise. No policy limits remedies for defective or misdescribed goods where protected by law.

7. Intellectual property

The Services, including text, designs, logos, images, video, and other materials, are owned by Hallowicked or their respective licensors and protected by applicable intellectual-property laws. You may access them for personal, non-commercial shopping use. You may not copy, redistribute, sell, modify, or exploit protected materials without permission or another lawful basis. Third-party trademarks belong to their owners; their appearance does not imply an affiliation beyond any expressly stated relationship.

8. Optional tools and third-party links

We may offer access to tools or links provided by independent third parties. We do not control their services, content, availability, or privacy practices. Review the provider’s terms before using them. To the extent permitted by law, optional third-party tools are provided as available without our endorsement or warranty. Nothing here excludes responsibility that cannot lawfully be excluded.

9. Relationship with Shopify

Hallowicked is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Hallowicked. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Hallowicked, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Hallowicked, to the extent permitted by applicable law.

10. Privacy

Our Privacy Policy explains how personal information is collected, used, and disclosed. Shopify also processes information to host and support the Services under its Privacy Policy. Information may be processed in countries other than your own as explained in the relevant policies.

11. Feedback and reviews

If you submit reviews, suggestions, images, or other feedback, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and adapt that material to operate and promote the Services, subject to applicable law and our Privacy Policy. You must own or have permission to share the content, disclose relevant incentives or affiliations, and avoid false, unlawful, abusive, or infringing material. We may moderate content that violates these requirements. You remain responsible for your submissions.

12. Errors and omissions

We may correct inaccurate product, price, promotion, availability, or delivery information. If an error affects an order, we will notify you and provide an appropriate correction, cancellation, or refund as required by law. We will not substitute a materially different item or charge a higher price without your agreement.

13. Prohibited uses

You may not use the Services to violate law, infringe rights, harass others, commit fraud, submit false information, distribute malware, send spam, harvest personal information, interfere with operation, or bypass security. You may not impersonate Hallowicked, Shopify, or another person. We may restrict access for violations, subject to applicable law.

14. Termination

We may suspend or end access for a material breach or unlawful activity. You may stop using the Services at any time. Obligations that by their nature survive, including payment obligations for accepted orders, intellectual-property protections, and lawful liability provisions, remain effective. Termination does not eliminate applicable refund or consumer rights.

15. Warranties

We aim to provide accurate information and reliable Services, but cannot guarantee uninterrupted or error-free access. Except for express product promises and warranties or rights required by law, the Services are provided as available. Any exclusion of implied warranties applies only to the extent legally permitted. Your statutory rights for product quality, safety, description, and remedies are unaffected.

16. Limitation of liability

To the extent permitted by law, Hallowicked and its service providers are not liable for indirect or consequential losses arising from use of the Services. No provision excludes or limits liability for fraud, intentional misconduct, negligence causing death or personal injury where exclusion is prohibited, or any other liability that cannot lawfully be limited. Any limitation applies only where and to the extent enforceable.

17. Indemnification

To the extent permitted by law, you agree to compensate Hallowicked for reasonable third-party claims and costs caused by your unlawful use of the Services, infringement of third-party rights, or material breach of these Terms. This does not apply to losses caused by our own unlawful conduct. We will notify you of relevant claims and will not agree to a settlement imposing non-monetary obligations on you without your consent.

18. Severability

If a provision is unenforceable, it will be limited or severed only as necessary, and the remaining provisions will continue to apply.

19. Waiver and entire agreement

A failure to enforce a provision is not a waiver. These Terms, the linked store policies, and any express terms agreed for your order form the agreement governing the Services, subject to rights and representations that applicable law protects.

20. Assignment

You may not transfer obligations under these Terms without our consent. We may transfer our business or rights and obligations where lawful, without reducing your mandatory consumer rights.

21. Governing law

These Terms are governed by applicable United States law and the laws applicable to the business at the address below, except where mandatory consumer law in your jurisdiction provides otherwise. Nothing in these Terms removes a consumer’s right to bring a claim in a court available under mandatory law.

Headings are provided for convenience and do not change the meaning of these Terms.

23. Changes

We may update these Terms by posting a revised version and effective date. Material changes will be communicated as required by law. Changes apply prospectively and do not remove rights arising from an earlier order.
